Welcome to Hyperbits LLC (referred to as “Hyperbits,” “we,” “us,” or “our”). By accessing or using our websites, products, and services, including but not limited to the Hyperbits Masterclass, Mix Master Flow, Start to Finish courses, The Songwriting Matrix, Hyperbits Bootcamp, Hyperbits Groundwork, Opus Vocal Sample Pack, Creative Suite, Elevate, Boom, Mighty, Nostalgia, and Atmosphere (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.
1. General Terms
1.1 Acceptance of Terms
By accessing or using our Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree with any part of these Terms, you must not use our Services.
1.2 Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website or notifying you through other means. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
2. Accounts and Access
2.1 Account Security
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. Sharing your login credentials is strictly prohibited and may result in account suspension or termination.
2.2 Account Lockouts
Multiple simultaneous logins from different devices or locations may trigger security measures, including temporary lockouts. Repeated violations may lead to permanent suspension.
3. Intellectual Property Rights
3.1 Ownership
All content, materials, and resources provided through our Services, including but not limited to text, graphics, logos, images, audio clips, video tutorials, and digital downloads (“Content”), are the property of Hyperbits LLC or our content suppliers and are protected by international copyright laws.
3.2 Restrictions
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the Content without our prior written consent.
4. Opus Vocal Sample Pack Terms
4.1 License and Usage

Royalty-Free License: The Opus Vocal Sample Pack (“Opus”) is provided as a 100% royalty-free sample pack. You are not required to pay additional royalties or fees for using the included audio files (“Samples”) in commercial or non-commercial projects, provided you comply with these Terms.

License Grant: Upon purchase of Opus, you are granted a non-exclusive, non-transferable, single-user license to use the Samples for your own personal and commercial musical productions, compositions, and remixes.

Permitted Uses: You may use Opus in music production across any genre or style, including streaming, sync placements, public performances, and distribution.
4.2 Restrictions

Redistribution Prohibited: You may not redistribute, resell, sublicense, or repurpose the Samples, individually or as a collection, in any downloadable, resellable, or accessible format.

Prohibited Uses: You may not use Opus or any of its Samples to create:

Other sample packs, sound libraries, or sound effects for resale or free distribution.

AI-based sample generation or machine-learning models without explicit permission.

Content that is illegal, obscene, defamatory, or hateful.

Modification of Samples: Minor edits for integration into your productions are permitted. However, you may not substantially alter and redistribute the Samples as new sounds or sell them as standalone assets.
4.3 Unauthorized Use and Legal Consequences

License Verification: The Opus Vocal Sample Pack is licensed solely to paying customers. Unauthorized use constitutes an infringement of intellectual property rights.

Legal Action: Unauthorized users may face immediate legal action, including substantial fines, payment of lost licensing fees, and, where applicable, royalties owed based on the commercial success of the infringing work.

Right to Audit: We reserve the right to investigate unauthorized use and pursue all available legal remedies.
5. Refunds and Cancellations
5.1 General Refund Policy

- Opus, Creative Suite, Elevate, Boom, Mighty, Nostalgia, Atmosphere: Due to the nature of downloadable digital products, refunds are not available for these standalone products once purchased. However, if you’re unhappy with your purchase we offer a 100% credit equal to the amount spent, which can be applied toward another Hyperbits product or course.
Refund requests must be submitted in writing to [email protected] within the specified timeframes.
5.2 Payment Plans and Failed Payments
Payment plans are binding agreements. Failed payments may result in temporary account suspension until the issue is resolved. Persistent non-payment may lead to account termination and collection actions.
I understand if I have an unpaid balance with Hyperbits LLC and do not make satisfactory payment arrangements, my account may be placed with an external collection agency. I will be responsible for reimbursement of the fee of any collection agency, which may be based on a percentage at a maximum of 35% of the debt, and all costs and expenses, including reasonable collection and attorney’s fees incurred during collection efforts. In order for Hyperbits or their designated external collection agency to service my account, and where not prohibited by applicable law, I agree that Hyperbits and the designated external collection agency are authorized to (i) contact me by telephone at the telephone number(s) I am providing, including wireless telephone numbers, which could result in charges to me, (ii) contact me by sending text messages (message and data rates may apply) or emails, using any email address I provide and (iii) methods of contact may include using pre-recorded/artificial voice message and/or use of an automatic dialing device, as applicable. Furthermore, I consent the designated external collection agency to share personal contact and account-related information with third-party vendors strictly to communicate account-related information via telephone, text, e-mail, and mail notification.
6. Courses Terms
This section applies to all Hyperbits LLC courses, including but not limited to the Hyperbits Masterclass, Mix Master Flow, Start to Finish courses, The Songwriting Matrix, The Hyperbits Bootcamp, and Hyperbits Groundwork (collectively, “Courses”).
6.1 Educational Material Usage
All materials provided within the Courses, including but not limited to video lessons, audio files, course slides, written guides, templates, and assignments (“Course Materials”), are the exclusive property of Hyperbits LLC and are protected by copyright laws.
- Usage Restrictions: Course Materials are for personal use only. You may not reproduce, distribute, modify, or repurpose any Course Materials for commercial, educational, or other purposes outside of your individual use.
- Prohibited Actions: Repurposing, rebranding, or redistributing any Course Materials, either in whole or in part, for sale, licensing, or educational instruction outside of Hyperbits LLC’s offerings is strictly prohibited. Unauthorized use may result in account termination, legal action, and/or penalties.
6.2 Access and Non-Transferability
- Access Duration: Students will have access to Course Materials for a specified duration (e.g., lifetime or 12-month access) depending on the purchased course. Continued access is contingent on compliance with these Terms.
- Non-Transferable Enrollment: Course enrollment is strictly non-transferable. Only the individual who purchased the course may access the Course Materials and resources associated with it.
6.3 Course Format and Content Changes
Hyperbits LLC reserves the right to change, modify, or update the format, content, schedule, or delivery method of any Course at its discretion. We will attempt to inform students of significant changes, but continued enrollment in any Course constitutes acceptance of these changes.
6.4 Limited Liability
Hyperbits LLC is not liable for any direct, indirect, incidental, or consequential damages resulting from the application or use of Course Materials. Results may vary based on individual skills and efforts.
7. Sample Packs and Tools Terms
This section applies to all Hyperbits LLC digital products, including Opus, Creative Suite, Elevate, Boom, Mighty, Nostalgia, and Atmosphere (collectively, “Sample Packs and Tools”).
7.1 License and Usage
Each Sample Pack and Tool is provided with a non-exclusive, non-transferable license for personal use in music production. This license is 100% royalty-free, meaning you are not required to pay additional royalties for using the Samples or Tools in commercial or non-commercial projects.
- Permitted Uses: You may use Sample Packs and Tools in your own music productions, sync placements, public performances, and distributions.
- Restrictions on Redistribution: You may not, under any circumstances, redistribute, resell, sublicense, or repurpose the Sample Packs and Tools, either in whole or in part, for any downloadable or resellable format.
7.2 Unauthorized Use and Legal Consequences
- License Verification: Unauthorized use of any Sample Packs or Tools constitutes infringement of intellectual property rights.
- Consequences of Unauthorized Use: Unauthorized users may be subject to legal action, including fines, payment of lost licensing fees, and, where applicable, royalties owed based on commercial success.
7.3 Refunds and Credits
Due to the nature of downloadable products, refunds are not available for Sample Packs and Tools. However, a credit equal to the amount spent may be applied toward another Hyperbits product or course.
8. Limitation of Liability and No Warranty
To the fullest extent permitted by law, Hyperbits LLC disclaims all warranties and shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services. The Services are provided “as is,” with no guarantee of accuracy, reliability, or uninterrupted access.
9. General Provisions
These Terms are governed by the laws of the State of California, USA. Any disputes will be resolved through binding arbitration in California unless required otherwise by law. These Terms, along with any policies posted by Hyperbits LLC, represent the entire agreement between you and Hyperbits LLC.
Hyperbits LLC reserves the right to remove content or suspend accounts that violate applicable laws or these Terms.
By creating an account, you agree to receive essential communications from us electronically, with an option to unsubscribe from non-essential emails.
